The Animal Welfare Act was signed into law in 1966. (2) Nothing in this Act applies to an animal while it is in its foetal or embryonic form. When the Animal Welfare Act was first amended in 1970, the definition of “animal” was expanded to include warm-blooded animals generally used for research, testing, experimentation or exhibition, or as pets, but it clearly excluded farm animals, including horses, livestock and poultry. The Animal Welfare Act 1999 governs the welfare of animals in New Zealand. It applies specifically to vertebrate animals (including fish), octopuses, squids, crabs, lobsters, and crayfish, but the general principles should also be applied to other species of animals kept in classrooms. There are changes that may be brought into force at a future date. (1) In this Act, except subsections (4) and (5), “ animal ” means a vertebrate other than man. Farm animals used as research subjects are covered by the act, but those used in the production of food and fiber are not. It empowers the Animal Care program of the USDA’s Animal and Plant Health Inspection Service (APHIS) to issue licenses and adopt and enforce regulations meant to protect the basic welfare of creatures kept in captivity. (3) The appropriate national authority may by regulations for all or any of the purposes of this Act— (a) extend the definition of “animal” so as to include invertebrates of any description; It is the only Federal law in the United States that regulates the treatment of animals in research, exhibition, transport, and by dealers. Other laws, policies, and guidelines may include additional species coverage or specifications for animal care and use, but all refer to the Animal Welfare Act as the minimum acceptable standard. The U.S. Secretary of Agriculture determines which warm-blooded animals are protected by the act.
